Terms
of sale.

§ 1Scope

These terms govern every contract concluded between the operator of editions.dmrschmidt.de (see imprint; hereafter "the atelier") and a buyer ("the customer") for the sale of photographic editions presented on this site. Deviating terms of the customer do not apply unless expressly agreed in writing.

§ 2Conclusion of contract

The presentation of editions on this site does not constitute a binding offer. By selecting an impression and completing payment via the linked Stripe Checkout page, the customer makes a binding offer to purchase. The contract is concluded when the atelier confirms the order by email, at the latest upon dispatch of the work.

Stock is reserved at the moment of successful payment. If an impression sells in parallel through another channel between the customer's offer and confirmation, the atelier will refund in full without further claim.

§ 3Prices and shipping

Prices are quoted in Euro and include applicable value-added tax under the margin scheme for works of art (§25a UStG). VAT is not separately disclosed on the invoice in accordance with that scheme.

Shipping costs are calculated by region and shown on the Stripe Checkout page before the customer authorises payment. See the shipping page for delivery times and carriers.

§ 4Payment

Payment is processed by Stripe Payments Europe, Ltd. The atelier accepts the means of payment offered on the Stripe Checkout page (typically major credit cards, SEPA debit, and selected wallet methods). The purchase price is due in full at the time of order.

§ 5Delivery and passing of risk

The atelier dispatches works after payment has been confirmed, typically within five working days. Lead times by destination are listed on the shipping page.

For consumer purchases within the meaning of §13 BGB, the risk of accidental loss or deterioration passes to the customer upon delivery of the work. For business customers, risk passes upon handover to the carrier.

§ 6Retention of title

The atelier retains title to the work until the purchase price has been received in full.

§ 7Statutory warranty

Statutory warranty rights apply. Defects, damage in transit, or deviations from the agreed specification should be notified within a reasonable period by email to contact@dmrschmidt.de, with photographs of the work and the packaging where applicable.

§ 8Right of withdrawal

Consumers have a statutory right to withdraw from the contract within fourteen days of receiving the work. The formal withdrawal notice and the model withdrawal form are set out on the dedicated withdrawal page.

§ 9Liability

The atelier is liable without limitation for damage arising from injury to life, body, or health caused by intent or negligence, and for damage caused by intent or gross negligence. For damage caused by simple negligence, liability is limited to breach of an essential contractual obligation and to the foreseeable, contract-typical damage.

§ 10Applicable law and dispute resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where the customer is a consumer with habitual residence in another EU member state, mandatory consumer protection provisions of that state remain unaffected.

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. The atelier is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions is unaffected.
